This is a novelty gift. The app is for entertainment, your data lives on your phone and only you can recover it, and your activation code is yours to use but not to publish or resell.
These terms govern your use of The Jelly Bean Jar, the companion web app at thejellybeanjar.com, and the activation codes supplied with our printed editions. They are an agreement between you and The Marriage Gazette LLC ("we", "us"), an Arkansas limited liability company. By activating or using the app, you accept them.
The Jelly Bean Jar is a novelty gift, sold for entertainment. It consists of a printed keepsake edition and a companion web app that counts whatever you decide to count.
It is not a medical device, a fertility tracker, a diagnostic tool, or relationship counselling, and nothing it displays is advice of any kind. The editorial commentary in the app is a joke written in the voice of a fictional newspaper. Please do not make decisions of consequence based on it.
No candy is included. The product is printed matter and a digital experience. There is no physical jar and there are no jelly beans.
Each printed edition includes a code that unlocks the app. That code is licensed to you for your own personal, non-commercial use, together with the person you bought it for or with.
You may use your code on more than one device in your own household, such as your phone and your partner's. You may not publish it, post it online, sell it, or distribute it. Codes that appear publicly may be retired, which would stop them working for everyone, including you.
We do not replace codes that were shared publicly. We will happily help if your card was damaged or missing from a sealed package.
Everything you enter is stored on your device and nowhere else. This is deliberate, and it is the reason the app has no account and asks for no email address.
The consequence is unavoidable and you should plan around it: if you lose the device, clear your browser data, or uninstall the app without exporting a backup first, your data is gone and we cannot retrieve it. We have no copy. Nobody does.
The app includes a backup and restore feature and reminds you to use it. Using it is your responsibility, not ours.
With a valid activation, we grant you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose. You may not copy, resell, rent, reverse engineer, or build a competing product from it, and you may not strip out or obscure our branding.
Do not use the app to break the law, to harass anyone, to attack or disrupt our systems, or to attempt to obtain activation codes you were not given. We may withdraw access for any of these.
The product is built around a two-year story, so the app has to outlive the purchase by some margin. We commit to operating the activation service and keeping the app available for at least 2 years from your date of purchase.
Beyond that period we intend to keep it running but do not guarantee it. If we ever decide to retire the service, we will post notice on this site at least 90 days in advance and provide a way to export your data before it happens.
Two things work in your favour here. Once the app is added to your home screen it keeps working offline, because it is stored on your device rather than fetched each time. And your data was always local, so it does not disappear because a server does.
We may also change, suspend, or update features, and we may take the service down temporarily for maintenance.
The Marriage Gazette name, the printed editions, the app, its text, artwork, and design are ours and are protected by copyright and trademark law. Your purchase buys you a copy to use and enjoy, not ownership of the work.
What you enter into the app is yours. We make no claim to it, which is straightforward given that we never receive it.
The app is provided as is and as available, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error free, or free of inaccuracies, and we do not warrant that the folklore is true.
Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill, arising out of your use of the product or the app.
Our total liability for any claim relating to the product or the app will not exceed the amount you paid for it.
Nothing here limits liability that cannot be limited under applicable law, and some states do not allow these limitations, so parts of this section may not apply to you.
Our products are sold through Amazon. Returns, refunds, and delivery are handled under Amazon's policies for the order, and those policies govern the purchase itself. If something is wrong with what arrived, contact us and we will help sort it out.
These terms are governed by the laws of the State of Arkansas, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Arkansas, and you and we each consent to those courts.
We may update these terms. The effective date at the top will change, and continuing to use the app after an update means you accept the revised terms. If a change is material we will say so on this page.
